They say that law is a system of rules. If you do a bad thing you will get punished, if you’re proven innocent then you’ll be free. But what if everything it’s not black and white. I’m here to talk about one case that changed law history. Like any other law criminal law is also a part of law, but it relates to criminal felonies. It controls community plan and forbid whatever is dangerous and harmful to the estate, aspect, security, and moral welfare of people.

Every man who violates this, will be punished.Everyone who kills or steal is a criminal offender. But in unusual actions defenses can apply to some peculiar acts. That act which I would like to talk about is the 19th-century English case of R v Dudley and Stephens, which tested a defense of necessity. I would like to explain the case.

The Mignonette was a ship that should sail from Southampton to Sydney. However, the boat sank and three crew members, including a 17-year-old cabin boy, were lost on a raft. They had nothing to eat and the boy was going to die first. The other had no choice and had to kill a boy and eat him.

Although they survived, because people found them, they were about to experience something unexpected. They were accused of murder. Their argument was that they had to kill the cabin boy because they wouldn’t survive. Lord Chief Justice Lord Coleridge, who was a prosecutor,then said: “to preserve one’s life is generally speaking a duty, but it may be the plainest and the highest duty to sacrifice it.” Their sentence was to be hanged, but all of sudden something strange happened.
